1. General Terms and Conditions

These General Terms and Conditions of Use and Terms and Conditions of Business (from now on “Terms and Conditions”) govern, together with the Privacy Policy and the Cookies Policy, the access and use of the website, accessible through the domain name miolivagourmet.com under the Mi Oliva Gourmet brand (hereinafter, “the Website”), as well as buying olive oil, and contracting products and/or services through it. The simple access to the Website attributes to the person who performs it the condition of User of the Website (hereinafter, “the “User”) and implies acceptance of all the terms included in these General Conditions. In case of not agreeing with these Terms and Conditions, the User must immediately leave the Website without using it.

By accepting these Terms and Conditions, the User agrees:

  • That they have read, understand and comprehend the what has been stated.
  • That they are of legal age in accordance with the legislation in force in their place of residence, in the case they are under the legal age they must seek authorisation from their legal guardians.
  • That, in the event that they are about to contract any product and/or service, they have sufficient capacity to do so.
  • That they assume all the obligations set forth herein.

The user must carefully read these General Terms and Conditions when they enter the website, since they are subject to change, although the modification of these General Terms and Conditions shall not affect any goods or promotions that have been purchased prior to such modification.

2. Conditions of purchase

The Website is accessible to customers anywhere in the world, although online shopping is only available for the Spanish Peninsula, the Balearic Islands and the European countries that appear in the “Country/Region” drop-down menu as available. Any other user who does not appear in the list of countries may contact us through info@miolivagourmet.com to process the order by another means.

2.1 Purchase process

Firstly, before purchasing, you can add as many products as you want in the “cart” or “shopping basket”. Once the products have been added to the basket, you will proceed to the payment procedure. In it, the user’s contact data will be requested, data that is saved in accordance with Organic Law 15/1999 of December 13th of the Personal Data Protection, Royal Decree 1720/2007 of December 21st, by which the Regulations for the development of the Organic Law and other regulations in force at all times are approved by the data protection law (see the Legal Notice and Data Protection section).

Then you can make the payment through the different payment methods. The information is not stored by us, but by the platforms indicated for this purpose. Payment is always made through a secure protocol (SSL), so that the data entered is sent encrypted. After making the payment, you will automatically receive an email with the order details, which will be processed within 24 hours, from 8am to 8pm, excluding bank holidays.

After making the payment, you will receive the invoice in electronic and paper format with the order, however, if you do not wish to receive the a physical invoice with your order, you only have to indicate it in the order options.

The arrival time of your order ranges between 48 or 76 hours in Spain and up to 7 working days for the rest of Europe, depending on the geographical location of the User and the day processed. Holidays and Saturdays are not included in this calculation. You can see the process of your order in your personal account on the Website.

3. Pricing Policy

 

The prices of the different products vary depending on the country in which the User is located. Remember that these prices are shown in each country thanks to geolocation, so the User must ensure that their IP has the correct location, since the final price will be that corresponding to the shipping address. In case of error, the User has the right to claim the amount or to pay or receive the difference in price.

If the User processes the order from one country, but the delivery address corresponds to another, the final price will always correspond to the latter address.

3.1. Shipping costs

Shipping costs will be calculated based on the weight of the product and the destination of the shipment. Until the customer has selected a delivery address (by default it will take their main address with which they registered or the last one used) said amount will not be calculated. In any case, the amount will always be visible to the User before making the payment and additional amounts will never be claimed after placing the order.

4. Forms and methods of payment

 

The payment methods offered by the Website are third-party property (Paypal, TPV Virtual, Bizum, etc.), via the payment gateway.

In order to use a credit card via a virtual TPV, the buyer should fill out a form indicating the card owner's name, the card type, the card's expiration date, and its security code. The Website does not have access to bank information linked to the payment methods, and does not learn or record this data during the payment.

5. Delivery conditions

 

We send products purchased online to the Spanish Peninsula, the Balearic Islands, and other locations within Europe, as long as they appear in the list of countries where the items may be sent.

The delivery costs fall to the buyer, and can be non-existant for certain products, locations, or delivery fees. In any case, the relevant delivery costs will be indicated during the purchasing process, and the buyer will have the opportunity to revise these costs before following through with any payment.

Mi Oliva Gourmet is not responsible for the delay in the delivery of orders for reasons not directly attributable to us, fortuitous cases or force majeure. The delivery of the orders will be made at the delivery address freely designated by the User. Mi Oliva Gourmet will not assume any responsibility when the delivery of the product does not take place as a result of the inaccuracy or falsity of the data provided by the User for this purpose, as well as in the event that the delivery cannot be made for reasons beyond its control. Mi Oliva Gourmet, such as the absence of the recipient at the delivery address.

In case of absence of the recipient and whenever possible, a passing note will be left with the necessary information to arrange a new delivery at the address of the recipient or the necessary instructions for him to pick up the product at a certain place . In any case, after 7 days from the last delivery attempt without the order being able to be delivered, it will be returned to origin and the contract will be terminated.

6. Return Policy

The buyer will have in any case a period of 14 calendar days after receipt of the product to exercise their right of withdrawal without having to justify reasons or receive any extra charges. To make such a return, the product must be in perfect condition and in its original packaging. Once the merchandise is received in our warehouses, and after checking its status, the amount will be refunded according to the payment method made by the client.

In accordance with article 102.d) of Royal Legislative Decree 1/2007, of November 16th, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, or the supply of goods that may deteriorate or expire quickly is applicable, so the right of withdrawal cannot be exercised on bottles that have been opened, for example, due to the rapid deterioration of the content in such cases.

The buyer must express their intention to withdraw within the indicated period and must return the product as indicated in ourReturn Policy.

Once the products that the return details have been received and their correct status has been verified, Mi Oliva Gourmet will return the amount paid to the User within a maximum period of 10 calendar days. Products that do not retain their original packaging may suffer depreciation.
